The White House says it is open to the idea of suspending the writ of habeas corpus — or the right to challenge one’s detention — for migrants as the administration looks to speed up its mass deportation operation. The admission came on Monday morning as border tsar Tom Homan took to the White House press podium to highlight the administration’s efforts to deport migrants charged with crimes in the United States.

The Writ of Habeas Corpus is what allows you to get a court appearance. It forces the government to allow you to challenge the allegations against you.
Suspending this, for any reason, is tantamount to treason in a democracy.
The Constitution explicitly states that the privilege of habeas corpus shall not be suspended unless in extraordinary circumstances like rebellion or invasion where the public safety is at stake. He can certainly push the envelope, Martial Law next. He will say we have been invaded by the aliens [not the kind from outer space].

If the administration was serious about protecting citizens‘ rights, that’s what they’d do. Or some similarly large number. Yes, it would be expensive. Yes, those judges need training – develop a program to pay for law school student loans if they work as an immigration judge for X length of time. Try and think of solutions that protect the rights of Americans instead of immediately giving up and saying it’s not possible.

The right to a trial gives us a reason to not resist arrest. It gives the average citizen an expectation they will see a judge before being locked away forever. Remove that guarantee and you no longer have a citizenry that can be confident they won’t die if they don’t resist.
