Hallo! Ich bin vor einigen Monaten nach Deutschland gezogen und habe innerhalb einer Woche eine Mietwohnung gefunden. Glück gehabt, oder? Nun ja, meine Vermieterin war wirklich die Hölle, und ich bin mir ziemlich sicher, dass sie es ausnutzt, dass ich die deutschen Gesetze nicht kenne. Da ich bald meine Wohnung verlasse, möchte sie, dass ich mich um die *Besichtigungen* kümmere. Das ist meiner Meinung nach komisch, aber es stand im *Mietvertrag*, also kann ich mich nicht beschweren … Aber jetzt, wo ich in den *Osterferien* in den Urlaub nach Spanien gefahren bin, ist sie sauer auf mich, weil ich keine Besuche arrangieren konnte, und sagt, dass ich Ich hätte jemand anderem meine Schlüssel geben sollen, um die Besuche statt mir durchzuführen. Auf dem Foto sehen Sie die einzige Klausel in meinem Vertrag, die *Besichtigungen* betrifft. Ich glaube nicht, dass dort geschrieben steht, worum sie mich bittet, aber vielleicht denken Sie anders? Because you are already leaving on a set date you have as stated a „Mitwirkungspflicht“ and need to make possible any „Besichtigung“ that was announced at least 3 days prior to the date.
And if you can’t *you* have to give a new date when you can.
Giving a trusted friend the keys while you are on vacation would indeed have been an easy solution.
You have the obligation to allowed a future tenant to see the flat. At the same time you don’t have to be available always and at any time.
It’s a balance between yours and your landlords interests.
So the question is how long are you out of country and how much time ti’s left? If you have 6 month left and you leave the country for one week, then the possible tenant can come at any other time. If it’s only one month left and your are out for 3 of the 4 weeks then your landlord is rigth and you have the obligation to make a visit possible.
