Hallo Reddit,

    Ich habe kürzlich ein Auto bei Sixt in Düsseldorf gemietet und stecke in einer frustrierenden Situation fest. Ich habe mich für die Grundversicherung entschieden, die eine Selbstbeteiligung von 1.100 € beinhaltet. Da meine Kreditkarte leider keine Kollisionsversicherung bietet, bin ich mit dieser auf mich allein gestellt.

    Folgendes ist passiert: • Als ich das Auto abgeholt habe, stand im Vormietbericht, dass die Windschutzscheibe bereits beschädigt war. • Ich habe das Auto genommen, dieses Mal aber weder Videos noch Fotos gemacht (ja, ich weiß, Anfängerfehler). • Nach zwei Tagen habe ich das Auto zurückgegeben und Sixt behauptet nun, es gäbe einen neuen Schaden an der Windschutzscheibe, der während meiner Anmietung entstanden sei.

    Die Sache ist: 1. Der Schaden auf dem Bild, das sie mir geschickt haben, ist kaum sichtbar. Es könnte leicht etwas bereits Vorhandenes sein. 2. Ich habe sie gebeten, vor der Anmietung Fotos vorzulegen, die beweisen, dass die Windschutzscheibe unbeschädigt war, bevor ich sie gemietet habe, aber sie haben nicht geantwortet. 3. Sie haben meine Kreditkarte und drohen, mir die vollen 1.100 € Selbstbeteiligung in Rechnung zu stellen, wenn ich nicht zahle.

    Das fühlt sich unfair an und als würde ich ausgenutzt, zumal im Vormietbericht bereits ein Schaden an der Windschutzscheibe festgestellt wurde. Wie kann ich überhaupt beweisen, ob ich es verursacht habe oder nicht?

    Welche Möglichkeiten habe ich hier? Sollte ich die Angelegenheit an eine Verbraucherschutzbehörde weiterleiten oder mein Kreditkartenunternehmen einbeziehen, um die Gebühr anzufechten? Für Ratschläge oder ähnliche Erfahrungen wäre ich sehr dankbar!

      What did it say about it in a) the receipt on pickup b) the receipt on return?

    3. Oh f**k SIXT. (They permanently closed my account and charged me 2 times with big amounts of money).
      I recommend you to do a police report about this one.
      Can also be done online.
      And let them now about this.

    4. Sixt inspects all their cars very detailed after every rent to find the smallest damages to the Car, like these stone chips in your pics.
      Even though you have not the full insurance Sixt doesnt charge their customers in 99% of the cases, at least for damages the size you have shown. BUT they could charge you for it If they wanted since the rental agreement you signed states also these cases.
      Since you too cant prove that you didnt cause these damages I’d say dont cause trouble at Sixt and hope for the best. Wait some days for your deposit to return, and if it does not return start asking questions. Most Sixt workers are on your side and would help you if you have Problems and want to solve them.

      Looks like Sixt has a weak case: pre-rental report mentions damage already, and the speck in this pic could just as well be dirt. They need to proof 1. there even is damage and 2. it’s new damage. So personally I wouldn’t pay, but escalate instead. I’m fortunate enough never having had to do that though, so I unfortunately cannot tell you how.

      Stone chips on rental cars are considered unavoidable events and cannot be attributed to the renter’s fault. Generally, they are not repaired at the renter’s expense. The risk of stone chips is beyond the control of both the renter and the rental company.

      It all comes down to what is written in the contract
