      This reimposes a tariff on **non-CUSMA complaint Canadian goods**, after the fentanyl tariffs were struck down by the Supreme Court last year.

      The fentanyl tariffs on Canada were 35%. These tariffs are 10% for „forced labour.“

      Working for a brokerage that heavily deals with US imports, so here’s a quick little break down of the chain of events and high level of what these tariffs mean.

      This „new“ tariff, is essentially the continuation of two previous trade programs.

      First, were the Ieepa tariffs, which were often referred to as the Fentanyl tariffs. They were done under the emergency economic powers act. Originally targetting Canada and Mexico, these expanded shortly after to also include „reciprocal tariffs“(you might remember Trumps presentation with his little whiteboard.). For Canadians, these applied to any good that was either 1) Not covered under CUSMA or 2) Not An Auto, An Auto Part, or some metals(Steel/Aluminum).

      These were struck down earlier this year as illegal. They were immediately replaced with temporary tariffs that had a fairly short expiry. These are what are known as Section 122 tariffs, they expire tonight at midnight. They were not illegal as this headline seems to suggest. These section 122 tariffs replaced all of the ieepa tariffs under very similar rules, and were infact much simpler to deal with.

      As these tariffs had a set expiry, these new tariffs announced here are completely expected and shouldn’t be a surprise to anyone. We haven’t gotten the full details yet, however, I would expect that these new tariffs will follow the same general rules and duty rates as the previous sets of global tariffs. Shouldn’t affect CUSMA goods, Auto industry or flagged metal materials.

      The IEEPA tariffs struck down by the Supreme Court were already replaced immediately by the Section 122 tariffs, which have been active for 5 months. These „new“ tariffs replace the Section 122 tariffs, not the IEEPA tariffs struck down by SCOTUS. The tariffs never went away after the SCOTUS ruling; it only made them change the law that they used to apply tariffs. So just like with the Section 122 tariffs, these „new tariffs“ don’t really change anything.

      I would wonder why the tarrif law doesn’t specify that the tarrifs would affect only those industries or individual businesses that they can prove use forced labour.

      Also, how can they prove the claim, given we already have laws that prohibit forced labour in supply chains.

      I wonder if there are ways to challenge the tarrifs through WTO

      That’s rich, coming from the country with a for-profit prison system with the most inmates in the world. There are about 930,000 prisoners in the US who are forced to work for between 12 and 40 cents per hour.

      But yeah, tell us about the forced labour in the rest of the world.

      Every accusation is a confession, forced labour is still legal according to their constitution.
