They certainly would’ve been close enough to accept his surrender, but it doesn’t seem like he attempted to, from what we can see. It rather looks like he drops his rifle in order to retrieve it after jumping. Shooting him after the drop therefore is legitimate. However, the soldier running up to him afterwards does appear to shoot him point blank when he already seems to be out of the fight, I am fairly certain that constitutes a warcrime. I could be wrong and he’s just checking if the threat is gone, it is hard to tell from the footage whether he is firing or not.

Dang it looks like he gets hit in the leg climbing out of the window and blood splatters on the wall. What a way to go
