It depends on the region. In the U.S., prediction markets are regulated as financial exchanges under the CFTC, which has federal jurisdiction, thus allowing prediction markets to operate in all 50 states.
Also, the case can probably be made that most prediction markets involve skill-based competition. In these markets, you have to research and analyze data to be consistently profitable. This is different than a casino or lottery where it’s mostly luck.
