  3. How is it a free speech issue that you are unrepentant of your crime!? If you say „I like killing minorities and will continue to do so“ after being convicted of murder, how can that not be taken into account!?

    While true I’m seeing a lot of headlines that don’t mention the fact that the ruling upheld her conviction, they just said her continued election lies can’t be used to justify her sentence. They also threw out the argument that Trump could somehow pardon state crimes.

    So… she’s not getting out of prison, it’s just the amount of time she spends there may change.

  5. Reminder that all the „evidence“ in the ~60 court cases for „election fraud“ were from affidavits from the MAGA faithful who claimed that they „think“ they saw something.

    Since there was no actual evidence Giuliani would make fraud claims *outside* of court but *inside* he would literally say that the case was not about fraud.

    Colorado Attorney General Phil Weiser issued a statement about the decision, saying Peter’s original sentence was fair and appropriate:

    *“The original sentence that the court imposed on Tina Peters for illegally tampering with election equipment was fair and appropriate. The Court of Appeals raised concerns about the length of the sentence and asked a district court judge to reevaluate the sentence. Ms. Peters is in prison because of her own criminal conduct to prove false claims of voter fraud in the 2020 elections, and she has not shown any remorse for her actions.*

    *“Whatever happens with her sentence, Tina Peters will always be a convicted felon who violated her duty as Mesa County clerk, put other lives at risk, and threatened our democracy. Nothing will remove that stain.*

    *“Moreover, the court affirmed that the president’s pardon of Tina Peters is meaningless and won’t free her from prison. Presidential pardons do not extend to state crimes, and the president cannot wipe away Ms. Peters conviction with a stroke of a pen.“*

It is important to note that this does not throw out Peters‘ criminal conviction, just says that they must come up with a different sentence that does not consider her motivations for committing the crimes she committed. She is still a convicted criminal, it is just not clear what her sentence will be.

    How long before Trump says he is the reason she was released and she will play a role in the mid term elections.

    They have been signaling for months that she was going to be released.

    I watched her sentencing and she got that term because she kept pushing falsehoods and was not remorseful.

    ENFORCE THE CONSTITUION!!!

    By letting this bitch off the hook the higher court violates Section III of the 14th amendment by aiding and abetting an insurrectionist – an enemy of the state. They should be removed from office immediately and the sentance reimposed by the governor.

    But Democrats will prove to lack a spine once more.

    She’s not an election denier. She knows who won the election, everyone knows, and she knew at the time.

    She is an election saboteur, who tried to hack into election equipment to change the result and exposed voters‘ data.

    Don’t judges regularly cite a lack of remorse during sentencing? I don’t understand why that would be an issue here even if true.

    Sweet so the lower court can sentence her to 3 years for each felony offence served sequentially with no parole. Plus 1 year for each misdemeanor.

    Jared Polis cracks me up. He is a Democrat in Name Only. The only reason he is a democrat is because he is married to a man and the party he aligns with wouldn’t accept him for that.

    He has spent his whole tenure trying to extend an olive branch to MAGA but they hate him not because he has genuinely fucked over the state in many ways (especially in healthcare), but because he is a „DeMonRaT“ and Gay. True republicans would actually love how this dude sides with corporate healthcare. He also bent over backwards to bring Palantir to Colorado.

    He was my graduation speaker at CU Boulder and I boycotted it because of how he treated first responders during the pandemic (I as an EMT was placed in the same „Urgency“ as funeral home directors to receive the vaccine, below other healthcare workers despite me spending often hours at a time in the back of a poorly ventilated ambulance with a COVID patient coughing up lung butter). He also apparently used ChatGPT (openly, he stated it as such) to write that speech.

    Every time you see a court decision you think is good – wait, it’s gonna be undone on appeal almost every time.

    Like that recent one about social media is gonna get thrown out too.

    Just to be clear they didn’t throw it out, they sent it to the lower court to be re-evaluated. She could still get the original sentence reinstated by the lower court.

    So basically they’re saying the 9 years was calculated by the trial judge using her „free speech“ against her… and so they need to resentence her with a more appropriate amount of time?

    Doesn’t every criminal get told: anything you say can and will be used against you in a court of law? 

    Is that no longer valid in Colorado? Your statements will only be held against you, as long as they are not truly held beliefs?

    Freedom of speech isn’t freedom from consequences.  Tina Peters’ continued push of the _lie_ that the election was stolen showed the judge she was unrepentant and, if given the opportunity, would do it again.  All of which can, and should, be taken into account for sentencing, and something he explicitly said during the sentencing.
