Well, if LLM companies should be paid, then those whose data they use to train their LLMs should be paid.

      Isn’t it only logical?

Is it fair use if I illegally download content but use it to train a local LLM?

    3. Fair use was designed for commentary, education, and parody. Training a commercial product on someone’s work without permission or payment is just regular use with better lawyers.

You can’t move content to another service and provide it without compensating the source service.  And in the age of the internet, ad revenue at source is also part of that compensation.

The argument against it is that unscrupulous companies or countries will do it anyways, handicapping those who play by the rules.  So, that has to lead to tighter controls on the data itself, and possibly on the paths to access it, otherwise it’s all going to favor the cheater anyways.
