Honestly, the part that floors me isn’t even the punch it’s the fact that a grown man with 24 previous convictions can hit an 11 year‑old on public transport while already on a suspended sentence and still walk out with “one final chance.”
If you’re about to become a father and your instinct in a minor row is to swing at a child, that’s not “overprotective,” that’s a massive red flag. The court bending over backwards because he’s a “talented musician” with a record deal is just the cherry on top.
Meanwhile every parent in the country is supposed to trust that their kids can sit on the Dart without some lad on bail deciding they’re fair game.
But sure look suspended sentence number… what are we on now, three? four? that’ll sort it.

Yes one more chance to offend. Why not

> Diasivi’s partner is due to give birth shortly and he will be required at home to mind their infant while she is in hospital, counsel said. He is working part-time and is a “talented musician” who has been signed by a record label, Clarke said.
Probably the only reason he did not go to prison.
> Yesterday, Judge Orla Crowe said it was “hard to understand how a situation could break out on a Dart in relation to people who were traveling into town, but it did and he got involved.”
Presumably the judge has never used public transport.

What actually gets a sentence un-suspended? You would think assaulting a kid would do it but I guess not

So he punches an 11 year old for looking at them, gets painted as a talented musician with a record deal and blames the assault on being overprotective of partner because they had a miscarriage. How the fuck does that make any sense

The system is tilted towards finding reasons to keep people out of jail, but to be fair to judges they are also aware that the prisons are operating above capacity and I’d bet that influences their thinking significantly.
If politicians could pass a law in the morning dictating that “x prior convictions = automatic sentence” the question would come back “and where will we house them, given you’ve barely built any prison capacity in 20 years?”

If he does serious harm to someone in this time, the judge (Orla Crowe) should be held liable.
Of course they won’t be, but they should in this particular instance, such is the outrageousness of this ruling.

His musician name is BK Humble. Pure shite, and I wouldn’t expect his career to go anywhere. Better off turning that part time into a full time job.

Second chance me arse. He’s obviously got issues. Id put money on it we will see this guy in action again.

This guy now has 25 convictions. He shows zero sign of learning or changing his anti-social behaviour. BUT the key thing here is that very fact. He is clearly going to offend again and again. Therefore he is what the Justice Industry refer to as a Cash Cow. Every conviction generates tens of thousands of euros of revenue between the solicitors and barristers on both sides. The only people who benefit from keeping him on the streets are the very people who profit financially from him being free to commit more crimes.

I had to chat to a Garda last week and my arsehole tightened because I’ve been raised to respect and somewhat fear the law. Because if I do wrong, I will be punished.

Is there an actual reason judges keep letting these people go? Are judges responsible for not letting prisons get too full or is it something else?

Exactly what is keeping the general population from just doing whatever we like whenever we like it?
Most of us are working hard to pay our bills on time, keep our cars on the road legal, paying our tv licences and trying to be decent neighbours.
What’s to actually stop us just stealing what we want and punching anyone that gets in our way?
There really appears to be a two tier justice system emerging in this country. The middle class will have the book thrown at them for any minor infractions, and have to foot the bill.
While everyone else appears to do what they want while being supported financially by the taxes the rest of us pay to fund them, and never have to face any consequences for their illegal actions.

One last chance. This guy is a scum bag, attacked a kid because he was speaking Polish.

Racially motivated attack by the looks of it.

Build more prisons you inept, pathetic bunch of lazy cunts. It’s not difficult. How many more suspended sentences need to be issued to repeat offenders and brazen „it was just resting on my hard drive your honour“ pedophiles for something to change.
I just want to know why nothing is changing. The government know the country needs more prisons, more houses, stable utility bills, better roads/schools and transport. This is something they’ve known for decades, they have the ability to change that and they still don’t. I just don’t know what they gain from not doing these things, it’s bonkers.
