Yeah, no Tusla I don’t think letting people who kills their spouses still have rights to the children is a good call. We know most abuse comes from family so maybe don’t house children with a literal domestic abuser and murderer.
Edit: Glad everyone is happy to ignore that 80% of child abuse comes from parents/legal guardians for the rare chance that maybe theres an edge case where the kids will be fine. I’m sure those kids who grow up having to live with someone willing to kill their partner will be graaaand.
Terrible article which misleads by making it sound like *anyone* convicted of a killing would be barred from access to their children by the state. The law in fact would apply only to parents who kill the other parent of the surviving children.
Nevertheless, in my view this is an example of an area of law so extremely sensitive and fraught with complex emotion that it is far better left to the discretion of judges in each case than blanket legislation tying judges hands in all cases. Probably in nearly all cases a judge would have no issue barring an abusive husband who murdered his wife from ever contacting their surviving children again. But what about victims of abuse who kill their abusers in moments of panic? There is no legislation which could possibly be fit for purpose in this respect.
My ex wasn’t barred from ever contacting us again when he had been charged and admitted sexually abusing our child. Tusla pressured me into doing supervised visits with him “because he was still their father”.
