Stories like this tend to land hard because they highlight how fragile outcomes can be when the process itself breaks down 🙁

That 2016 ruling clearly did a lot more harm than good, it should be reevaluated.

Courts need to stop putting the rights of criminals ahead of victims or it will make people (who hasn’t already), lose faith in the justice system.

You cannot put a fixed time on trials especially when there’s so many variables. Defence lawyers can keep delaying until the charges get stayed.

This is no justice for law-abiding citizens, only criminals.

Our Justice system has been molded around a High-Trust Society for the last century. A lot of decisions that came from the Supreme Court are extremely unpopular as of late.

The problem is our Society has deteriorated in the last decade to the point we’re declining into a Low-Trust Society. So we’ve go a bunch of persons in Canada who are familiar with frauding, scamming and cheating their way through their own society.

Unfortunately Canada and Canadians are just ripe to be exploited and all the boomers in power refuse to make change or can’t.

My buddy who did time for cocaine sales said that you can buy your way out of jail time with 1million cash to the judge. That’s what his crime boss did to avoid jail time and what his lawyer suggested he do but he didn’t have the money. 

The law states that you must go to a trial in a reasonable time. The governments don’t appear to want to fully fund the courts/ justice system to meet the requirements.

Is the time limit 2 years ? If the Justice system can’t bring a case in that time then there is a problem. Remember you are innocent until proven guilty.

Prosecution gave defence an excuse, a stupid one in that. If the material wasn’t exculpatory in their judgement, there’s process to still list it while maintaining privacy of individuals involved. They should have followed that path.

Province is also stupid for not funding courts better. There are many cases with no prosecutorial issue that go on forever without the accused getting their day in court and eventually the just walk. Multiple sexual assault cases were tossed last year too. Even simple traffic offences are going for 18+ months and getting dropped.

Fund the courts, appoint enough judges and prosecutors and all of this is solved.

Then there’s prison capactiy but that’s a whole different discussion.

The hired killer got out of his charges without a trial twice? How „lucky“ for him.

Don’t buy the crap about underfunded courts for a second.

The bonus for time served in pre-trial custody leads to easy convictions being fought just for the sake of it, and the revolving door ensures the same people are back in court over and over again.

The reason the courts are backed up….is the courts.
