      * Reps. Eric Swalwell (D-Calif.) and Dan Goldman (D-N.Y.) are planning to introduce a bill that would strip federal Immigration and Customs Enforcement (ICE) officers of their qualified immunity protections.
      * The bill, called the ICE OUT Act, comes amid fervent debate over whether an ICE officer should face criminal prosecution for the fatal shooting of 37-year-old Renee Nicole Macklin Good on Wednesday.
      * The shooting put renewed attention on the Trump administration’s immigration enforcement tactics and called into question whether the officer’s use of force violated state or federal law.
      * Federal law enforcement officers have broad legal protections when acting in the scope of their official duties. Still, states can bring charges under certain circumstances, including when an officer’s actions violate the law or are deemed not to be “necessary and proper” to fulfill their duties.

      Seriously, qualified immunity needs to go. If individual ICE members are aware they can face civil consequences to their livelihoods for their gross negligence then maybe they’ll be more cautious about resorting to unchecked violence in every situation they face.

      The same people who defend qualified immunity are often the same ones who like to say „nobody is above the law“. You literally can’t believe in both.

      Let’s disarm them, too. Immigration charges arent felonies. They dont need 50 lbs of tactical hardware to arrest folks on administrative charges.

      My only complaint is they should eliminate QI entirely and not just for ICE. It’s an entirely made up doctrine with no basis in the law or constitution that has allowed horrific police abuse.

      No cop should have qualified immunity. We don’t live in a fairytale

      No one should have any immunity, not even you local pigs. Nothing will improve until they can face genuine consequences for harming you. As it stands, they do not give a fuck about violating you rights because it will never affect them. At best, you get to sue the municipality or county or whatever.

    12. Attorney here, once upon a time i worked at a firm that defended state agencies, including the department of corrections, against civil rights lawsuits (section 1983 claims). Let me tell you, while qualified immunity as a concept likely has place in our legal system to a degree, it has become nothing more than a functional bar against holding individuals responsible for just about everything.

      It should be easier to strip QI from these people, police officers and other LEO should have to carry insurance, and damages for this type of behavior should also come partly out of their retirement. It’s absolutely insane that these people can commit these acts with functionally no repercussions, except a paid vacation to a desk job or just sent off to another department to continue as though nothing happened.

      Even if they pass it, it’s going to get vetoed and then they don’t have the majority of a 60% vote to override a veto

      Every single ICE agent must be sent to CECOT or Guantanamo.

      Since they think that’s where criminals and terrorists belong, it’s only fair that they face incarceration for their endless violent crimes in those places.

      Great idea. I don’t think it will even make it to the floor, let alone pass in this congress, but it’s worth trying.

    16. How about we abolish qualified immunity all together?  Cops laugh at uninformed citizens who call themselves sovereign citizens because they know with qualified immunity all government actors are the real sovereign citizens.

      Qualified immunity needs to be gone for the whole country, maybe then cops can behave themselves

      Good. I also believe all ICE should have a visible identifier (think police badge number) on their uniform so they can’t hide behind face masks and swapped license plates. Database shouldn’t be public, but has to be readily accessible to be prosecuted for any crimes.

    21. One of the things lost in all this is that ICE, according to it’s own charter, has no jurisdiction over US citizens.

    22. The democratic candidate that I’m voting for is the one that says they are getting rid of ice completely and will be prosecuting every single one of these Nazis to the fullest extent of the law. And will be expanding the supreme Court

      It’s a start. But when Democrats take back the House, ICE must be abolished entirely, not „dramatically and overwhelmingly revamped“ as they suggest at the end

      Just strip all cops of qualified immunity. It’s been a disaster for civil rights.
