    1. >We need to remake the US high court so Americans don’t suffer future decades of oligarchy-facilitating rule

      Indeed

    2. If half the country thinks the Supreme Court is basically just nine political referees instead of an impartial arbiter, maybe it feels illegitimate because it mostly rules like it’s playing for one team. Polls shows trust has tanked and people think justices rule on politics, now law.

Utterly morally bankrupt. Poisoned the notions of impartiality, fairness and justice.

    4. At this point our entire government is corrupt and needs to be removed and things need to change. Checks and balances don’t work when all 3 are compromised.

    5. The Supreme Court isn’t supposed to be partisan, but lifetime appointments have turned it into a political weapon. Calling it illegitimate isn’t far off. Illegitimate or not, the Court has lost public trust. When decisions consistently align with ideology over precedent, people stop believing in the institution.

    6. Through July, *all* of the lower federal courts, including many conservative justices, ruled against Trump around 93% of the time.

This one court reversed that and ruled *for him* by roughly the same percentage.

If they seem partisan it’s probably because they are.

    7. Hey wake up America, other country burned to the ground for less corruption. Yall getting played by elites.

The solutions are lacking in the article. Other than forcibly removing justices or stacking the court; there aren’t many options. Unfortunately, our country has elected two presidents who didn’t win the popular vote who have appointed a majority of the current justices. Maybe we can do something about that? Bush (2001-2009) and Trump’s first term have seen the majority of appointments. The way we elect our presidents is broken and needs to be fixed.

100%. 6 have abandoned their oaths to protect the constitution. They have at many times violated plain text of the constitution and applied different strategies to applying the law whenever it benefited them. They are not a court of justice but lawlessness. Throw the book at them for their sedition when we’re cleaning up the country of MAGA.

I’m always looking for Clarence and his prevost. I just want to wave and say hi.

Law schools might as well not bother teaching any of the SC cases from the last decade. Legal contortion and gymnastics and illogical reversals of stare decisis are not tested on the bar exam.

    12. No. Shrunk it back down to five. 2 most recent leave. Now its a 3-2 dem majority.
      Then expand it again.

I am old – but if you google this „*is that a pubic hair on my coke*“ – then you’ll understand when I started to see the decline.

    14. Every case needs to be heard by a random lottery of 7 federal judges with the appropriate experience. If it’s a random lotto at least then you can’t stack the deck in your favor by bribing people who’ll be there for decades.

„Denny Crane: The Constitution says whatever the Supreme Court says it says. As for what the Supreme Court says, that all depends on who’s president.“

Why in the actual fuck did they design a system with infinite terms.. how did they not think this through??

    17. And just how does the author propose accomplishing this?

It is more magical thinking. Not a real prescription.

    18. CombinationLivid8284 on

Democrats need to commit to packing the court and adding term limits.

And if they have the votes to impeach all these far right corrupt justices.

We accepted this months ago–the question is how and what do we intend to do about it.

    20. Shoehorse13 on

Is it illegitimate? Absolutely. Should it be replaced? Absolutely. Will anything be done about it? Absolutely not.

Face it kids… this is our life now and the cavalry is not coming to save us.

    21. I have to ask, what should the citizens do when Congress no longer represents the people they “represent” and the Supreme Court does not protect them?

And the executive branch seems entirely unchecked, so we know where that stands.

Hey I’ve got a great idea

why don’t we institute a system where we have 9 people, you know to keep it simple, who can make decision effecting the freedoms, ability to work, and daily lives – the very life liberty and pursuit of happiness if you will – of over 300 million people.

We’ll have those people make their decision based on what they think 39 white men who owned slaves, hadn’t invented indoor plumbing yet… Even though Rome had it thousand years before, had never heard of the atom, or germs, and still believed in alchemy and witchcraft would have wanted.

Oh and better yet we’ll make them just given the job for life so no matter what they do we cant change it.

Oh and after we develop this system we will allow two corporate political parties to take control of how state elections run thereby allowing them to control federal elections which then allows them to control who gets appointed to this court removing most basic principles of democracy….

      Whose in favor

We have reached the position where more intelligent criminals will argue at trial that any laws they broke were justified under the lawless justice Department of the time.

It won’t work, because the Justice Department dispenses no justice to a common crook, but the billionaire swindlers will have good standing to say the laws didn’t mean shit during this era. Were I Elon Musk, that’d be my outlook to pull off whatever I please during the current reign of government.

    24. Maybe justices should actually go to jail for long periods for taking bribes? Just a crazy idea I had. Maybe every position of power would not be occupied by a criminal if rich, powerful people got locked the fuck up for being corrupt and stealing our money and rights.
