Trump’s idea is he doesn’t have to give due process if they’re not in America. Also, right now he’s pretty greatly expanding executive power due to him heavily using his powers as president (like weird justifications for executive orders). A bunch of his stuff is getting challenged at the supreme court level and these are big cases that could change decades and even centuries long precident. Some of that president could be crazy to undo and break, and would be a big shift into partisanship if the court moves away from history. Some of the other cases established precedent only because the courts were partizan at THAT time too (like the FDR case of him wanting to fire independent agency officials; the court was all republican during that time since the last 12 years had republican presidents, so FDR lost that case; FDR and his lawyers argued that he can’t run this country with regulatory heads undermining his agenda since the republicans who were the heads at that time didn’t believe in regulation too much while FDR did and regulation was a major part of his agenda). .
