While it remains to be seen how they will restore and adjust these new mandatory minimum provisions to avoid being struck down by the courts, this is the appropriate remedy. Amending the Criminal Code is appropriate and reflects a measured response to the issue. Invoking S33 has grown increasingly contentious thanks to provincial abuse, doing so by the federal government would likely be a bridge too far for all but the rabid conservative base.
My preference would be a built in override that allows the courts to go for a lower sentence where it can be substantiated. A formal, written reasoning that could be used to provide future parliaments data to further refine policy decisions.
my only question is, why? We do not need mandatory minimum sentencing. let judges decide. that’s what they are there for. This is just to pander to people that don’t trust our justice system as is. Bail reform is necessary. Things need to be done to prevent violent & harmful repeat offenders (and I don’t mean people just charged with crimes like possession of illegal substances). Mandatory minimum sentencing doesn’t solve either of those.
Good. The law can be fixed without the notwithstanding clause. Jumping straight to it would have been lazy and counter productive.
