Ein Teil meines Geschäfts liegt im Transportwesen, wir versenden LKWs durch ganz Europa. Vor ein paar Tagen bekam ich einen Brief vom Kreis Steinfurt, einen Teil davon habe ich hier gepostet. Ich habe die Fahrerinformationen wie gewünscht bereitgestellt, sodass wir sagen können, dass dieser Fall nicht in meiner Hand liegt, aber ich frage mich immer noch, wie das in Deutschland funktioniert.
Wenn ich den Brief verstehe, heißt es darin, dass mein Fahrer einige Fahrzeuge an einer Stelle überholt hat, an der keine Lastwagen vorbeifahren sollten, und dass dies von einem Bürger beobachtet (und gemeldet) wurde? Er erzählte mir, dass dies unbeabsichtigt passierte, bevor er bemerkte, dass sich ein Stau bildete, und dass er tatsächlich an zwei bis drei anderen Lastwagen vorbeikam, bevor sie es ihm ermöglichten, sich auf der rechten Spur zu verstecken. Er ist also schuld und muss es herausfinden. Aber es kommt mir seltsam vor, dass die Polizei nur aufgrund eines einzigen Augenzeugen handelt. Vielleicht haben sie ein Video davon oder so? Wäre das sonst nicht eine unlösbare Situation „Ihr Wort gegen mein Wort“?

As witness the Provida System is mentioned. It‘s a camera system installed in police cars (also civil vehicles) that films and documents the traffic.
Where do you get the „just 1 eyewitness“ from?
Depends. Police can start an investigation on things like that, but they haven‘t to (because normal speeding, overtaking where prohibited, parking in wrong spot and so on are not considered as crimes).
Most likely police notified the owner of the vehicle about the case and they stated that either of you two drove the car. Did the other guy (the driver?) also receive a letter? I believe he was asked as witness, too. But since you stated that he drove it depends what he answered. If he also stated that he was driving, then he will receive the fine. If he stated that you drove, then it is „my word, your word“ again and police will have no power to go any further for such a minor offence.
