
Stellungnahme zu Regel 10: Donald Trump behauptet, dass Demokraten, die versuchen, Angehörige des US-Militärs daran zu erinnern, dass es für sie tatsächlich illegal ist, rechtswidrigen Befehlen Folge zu leisten, Verräter sind und ein schweres Verbrechen begangen haben, heißt es in einer ungenannten Stellungnahme "Großartig" Rechtswissenschaftler.
Das Problem bei alledem ist, dass der Uniform Code of Military Justice deutlich macht, dass Militärangehörige nicht geschützt sind (und strafrechtlich verfolgt werden können), wenn sie einem rechtswidrigen Befehl Folge leisten. Im Handbuch der Kriegsgerichte heißt es ausdrücklich, dass eine Anordnung einen gültigen militärischen Zweck verfolgen, nicht im Widerspruch zu US-Recht oder der Verfassung der Vereinigten Staaten stehen und nicht gegen den Uniform Code of Military Justice verstoßen darf.
Angehörige des US-Militärs haben nicht nur die rechtliche Möglichkeit, rechtswidrigen Befehlen zu widersprechen, sie haben auch die Pflicht, dies zu tun. Dies wird neuen Rekruten in der Grundausbildung beigebracht. Warum scheitert der Oberbefehlshaber darüber?

Who’s job is it to interpret what is or isnt an unlawful order after its been disobeyed? And who’s going to risk getting charged with treason in front of a military tribunal based on the hope that the order they disobeyed will be considered unlawful?
Why haven’t there been any posts quoting what EXACT orders are being given out that are unlawful?

That’s the reason the Dems were being so vague in their televised PSA. They have yet to specify which orders they’re telling military personnel to disobey. Rest assured, they met with a crew of lawyers so that script could be approved prior to airing whatever that was because advising service members to disobey direct orders IS sedition and they wanted to be very, very sure they could get as close to that line as they legally could.
The whole affair was to sow doubt in the minds of service members who may personally dislike or even hate their commander in chief in order to foment some kind of crisis. They wanted to muddy the issue of whether an order a serviceman feels uncomfortable carrying out is an order he/she can disobey under the UCMJ (spoiler: it isn’t).
The shitty part of this is that some kid is going to catch an Article 92 and possibly spend a couple of years in a military prison for disobeying a direct order because they don’t like the order and some politician on TV told him he didn’t have to follow it.

Trump is right he is the democratically elected President, and when democrats tell service men not to follow orders, than say nothing about which orders or why, that is considered Treason.
Democrats need to start fighting for America instead of Illegals
we have allready learnt how trump prefers to „unalive“ to use his words people who travel on boats in international waters instead of following the usual procedure to stop them, take their drugs away from them and bring them before court where they might get a mild sentence if they were for example doing such smuggling tours for the first time

those people in boats were not doing any agression, they were not attacking anyone
because transporting drugs is not an agression itself
its the buyer who is responsible to buy or not something of unknown quality in a shady street corner what might have the consequence of dying from the consumption of such substances
also worth noting how there was someone with the united nations who recently called those murders out as „extrajudical killings“ and unacceptable behaviour in international waters

The Democrats never told the military to disobey Trump’s orders. They just reminded the military that they are not obey illegal orders. Hmmm, maybe Trump knows he is issuing illegal orders. Or should I say, Steven Miller et. al. are submitting illegal orders through Trump. I am not sure Trump knows what day it is.
