We’ve reached the Destruction of Evidence phase of the ICE Abuses Era. So noted.
It is unbelievable that each judge is forced to look at each of these cases independently, ignoring all of the other cases where this administration has willfully destroyed evidence and/or ignored judicial rulings. They just get to do bad shit over and over again, with no consequences AND with no memory in the system of their past misdeeds.
As i understand the law, if the government purposely or through negligence lost evidence thats proves a civil abuse they automatically lose.
Given all the security two weeks detention at this facility.

They know when this administration is gone, the next one will try to prosecute these ICE agents and anyone associated with them. They are preemptively removing evidence that will convict them.
Why isn’t there strict liability for failing to be able to produce the evidence? Even if the place burned down, off-site and redundant backups should exist. There’s really no excuse.

Courts can apply an adverse inference when a party destroys or withholds evidence, allowing jurors to assume the missing evidence would have hurt that party’s case.
