Yup, conservative premiers across the country normalizing it’s use and throwing a collective hissy fit when the feds say they want to address that is deeply concerning.
Poilievre repeatedly claiming he’ll use it if elected is even more worrying. The feds have never used it and as soon as that bulwark is gone were in deep trouble.
Seems like a better system to me, where elected politicians determine laws rather than judges. Are we not supposed to have parliamentary supremacy?

Ultimately, people need to decide how they feel about the NWC’s use. That was the intention of the Charter’s writers. They put it in as a way to keep the court system accountable to elected governments and voters, and ultimately it has served that purpose well. Most other developed countries‘ court systems have become openly politicized or very polarizing, while [ours is not](https://mbaccesstojustice.ca/canadians-genuinely-have-trust-in-the-supreme-court-but-there-are-warning-signs/).
We’ve seen here in Ontario that the government still backs off when they use the NWC without widespread public approval. If Albertans don’t push back the same way Ontarians have, then those voters will have spoken through their silence.
The SC has overstepped how boradly they can interpret the Charter and damaged their credibility. They are acting like they are the executive.
I hope to see the NC used more often, not less, until such time as the uneleted courts are brought to heel.
As evidence by yesterdays decision, we need to have a check on the supreme court. They need to be accountable like any other branch of government.
The NWSC partially achieves that, it allows elected politicians to talk to voters directly and defend their controversial policies when election comes around.
Is it perfect system? No its not. There is never a good time to preach constitutional rights. But guess what? we are not perfect, out judges are not perfect, our politician are not perfect. That why we trust and accept the collective judgement of our voters on election day.
