Yes! We are so here for it. The harder our governments push back on labour demonstration the more motivated we should be. Demonstrate before they make it completely illegal to do so. I support them!
I don’t know what other option you would take if you were a union leader and you were facing an imposed contract with use of the NWC. Trying to do anything but essentially going nuclear is basically abandoning any leverage or labour rights you had, it’s an impossible ask to accept that.
Even if the deal they get in the end isn’t all that different from the imposed one, it being bargained (or even achieved through arbitration) rather than imposed is extremely important if we want any notion of labour rights and collective bargaining.
This is absurd and shows what a lumbering dinosaur organized labor is in Canada. Nobody’s going to join them, aside from a handful of librarians, people with children want them in school. And the supposed inalienable Constitutional right to strike only dates back to 2015.
If Alberta’s labour movement doesn’t strike now, they won’t have any effective right to strike forevermore.
And not just Alberta: Conservative provincial governments in other provinces will see there isn’t any repercussions for using the Notwithstanding Clause to crush the right to strike, and that will be the end of the right to strike and collective bargaining for all workers across the country.
Alberta workers must act now, or sit down and take whatever employers dictate… forever.
The notwithstanding clause is proving to be an absolute poison pill that makes the charter basically toilet paper. If it can’t be used to restrain a government trying to suppress workers, then what is the point of it?
