Hallo zusammen, bitte um einen kleinen Verbraucherrechtshinweis. Ich habe einen Satz Winterreifen bei einem bekannten Online-Anbieter gekauft. Sie haben eine .ch-Adresse, aber das Unternehmen befindet sich in Deutschland.
Die Reifen sind angekommen, aber aus der Mitte 2018, mit einem Aufkleber, der darauf hinweist, dass sie für die Saison 2019 sind. Das Gummi fühlt sich sehr hart an.
Ich habe darum gebeten, diese zurückzugeben, aber das Unternehmen lehnte ab und sagte, auf der Website sei klar ersichtlich, dass sie aus dem Jahr 2018 seien. Wenn ich auf die Website zurückkehre, ist mir nicht klar, dass diese so alt sind. Sie müssen mit der Maus über das Wort „Punkt“ fahren, um das Datum anzuzeigen.
Grundsätzlich glaube ich, dass das Unternehmen mich absichtlich in die Irre geführt und mir etwas geliefert hat, das nicht nur seinen Zweck erfüllt, sondern auch potenziell gefährlich ist. Ich weiß, dass es in der Schweiz grundsätzlich nicht illegal ist, mit älteren Reifen zu fahren, aber im Falle eines Unfalls könnte es gegen mich verwendet werden.
Habe ich ein Rückgaberecht (auch wenn ich die Versandkosten selbst bezahlen muss) oder bleibe ich dabei? Fühle mich im Moment wirklich ziemlich betrogen und möglicherweise um über 600 CHF gesunken.
Jeder Rat wäre mir sehr willkommen, bitte…

If they aren’t used and in fact even write the manufacturing year on the website I don’t think there’s much you can do.
I’d just sell them on Ricardo. This will get you the most money with the least troubles, everything else is not worth the headaches.

Should be the first thing you check no? The DOT of the tires… it’s your fault in my opinion, you didn’t check it. Why would you order tires without checking that?
Take it as a learning lesson. Re-sell them or use them and move on
If the company is based in Germany then I assume the German laws apply on your case and then send them back. If I remember correctly, Germany got a law that allow customer to send back any product bought online, even if they’re totally good within x days

So if the tyres have been stored properly they have quite a few years left stil. The trouble is if the tyres have been used (then they recommend 5 years then regular check) or improperly stored.
The online website I used asked me if I want to use tyres produced this year for some extra money, was this offered to you as well?
