

Mir wurde am 18.09.25 gekündigt, nachdem ich am 29.04.25 meine erste Schicht angetreten und insgesamt 411 Stunden gearbeitet hatte. Ich habe in dieser Zeit nie bezahlten Urlaub genommen. Nach meiner Kündigung fragte ich, ob ich für nicht in Anspruch genommene Urlaubstage bezahlt werde, aber sie sagten nein und verwiesen auf meinen Vertrag. Ist das in Deutschland tatsächlich richtig oder legal?

well generally if your employment ends and you have unused vacation days you are entitled to **c**ompensation for those days. Your employer saying that your contract negates this right isn’t legal under German law (they can at least suggest you to take the vacation days owed to you), especially when it comes to minimum statutory vacation. I suggest you write to your employer and let them know about this but also seek legal advice for help or more info.
Why did you even work in September?
Payout is possible according to BAG, 9 AZR 365/10. But only if you couldn’t take all or part of your vacation days. E.g. you received a 2 week notice but have 4 weeks of vacation days left. Or the employer still needs your service until the end
I don’t think you can solve this without a lawyer. It’s up to you to decide if thats worth it.
You also don’t have a claim on the full 20 days. For that you need to work for at least 6 month for an employer. In your case. In your case you only have a claim on 5/12 of the vacation days or so.
It is important to take as much vacation days as possible. You will lose them. You won’t take them with you to your next employer.
On a side note, your employer sounds shady. Most employers I know grang 24-30 days.
