God. Barristers who do this should be banned or something.
I’ll never understand people who are paid for their experience and expertise using AI to effectively not use that experience and expertise.
Why hire them in the first place if that’s all they are going to do.
There was a similar case a couple of months ago were a Judge ripped a Barrister to shreds for using AI that cited cases that never occurred.
The golden rule of AI is that it will never tell you if its wrong or is making things up because it doesnt know.
It’s inexcusable when there are digital databases and services that exist that have case law and legislation in them, some of which are free (Bailii) and others are at a premium.
Some even have their own AI which should cite only existing cases but even then give you tools to verify what the AI brings back. Some even have reference checkers built in which at the very least check case citations and provide an editorially written summary.
How a practicing barrister couldn’t be bothered to go to any Inns of Court library or reference check any database, free or not, is so ridiculous they really ought to think if practicing the law is right for them.

Interesting podcast on this emerging phenomena.
Obviously very poor advocacy play a part but seems a lot of this is just a complete lack of support for junior legal professionals both pastoral and basic materials. One researcher wasn’t even given access to legal databases she literally only had wikipedia and ChatGPT to rely on.

It’s crazy to do this as looking in a legal database doesn’t take much time either. At the very least, it’s baffling that they didn’t cross reference the cases with legal databases to check their validity.
