the notwithstanding clause is a dictatorship waiting to happen. limiting it now is the best course of action in order to stop that pre-emptively
It’s not supposed to be used for such foolishness as removing bike lanes or burning books like they have planned for Alberta.
It looks like the Carney and Ford bromance is over.
I’m an anglophone in Quebec, hate Bill 21, but I don’t see a way around the notwithstanding clause. Our Constitution seems to allow provinces to draft laws that violate the Charter, it is a pointless document.
I think it should only be used if the legislatures of the provinces have vote it in with a supermajority 2/3. That is more than reasonable and can actually show there is a reasonable thought to using it.
Lol
You guys see a few non-elected judges as absolute gods that can tell us, down from the heavens, what is right or wrong, where intricate limits to rights should be.
How is that working for the US? Great, right? Versus the UK and other parliamentary systems that ensure elected officials have the final say?
I think you guys watch too much American TV or news. Our system was never meant to work that way. And I prefer it.
Colour me unsurprised that ~~Drug Lord~~ Doug Ford is upset at the prospect of losing his best weapon against labour rights or hell, any and all rights.
I think that you would have to open up the Constitution to make that change. No?
Both Federal and Provincial governments have use of these powers. Maybe the Federal government can somehow wave their right but the Provincial governments won’t.
I think those are empty words myself.
