Small businesses and states challenging the tariffs say Trump illegally invoked emergency powers to levy import taxes on goods from nearly every country, pushing them to the brink of collapse. Lower courts have largely sided with the challengers but left most of the tariffs in place while the case proceeds.

We are so far past the idea of „calling balls and strikes“ with SCOTUS. I mean, we are really deep into, „SCOTUS is the official judicial branch of the Republican party“ type of ratfuckery. These are literally unelected political actors that wield a majority power capable of rivaling both the Congress and President of the United States.
I would sooner vote to abolish SCOTUS than reform it. Also, just a reminder that SCOTUS is the reason our politics are so fucked up, it is a snake eating its own tail, see Citizens United v. Federal Election Commission, 558 U.S. 310 (2010).

Mark my words: this one is getting overturned. I’m an attorney and while it makes little sense to overturn the decision, it will be.
The dissent in the appeals court decision gives all the justification SCOTUS needs to say the IEEPA gives Trump carte blanche to impose whatever tariff he wants at whatever percentage he wants against any nation he wants on any dubious “emergency” basis he announces.
It’s sad to see the checks and balances I studied so hard once upon a time be swept aside in the name of power and ideology. It’s sad to see the Court twist itself into saying that legislative authority prohibits once President from canceling student loans while another president can use the world’s most sprawling, unrestricted interpretation of statute in completely usurping Congress’s constitutional role in enacting tariffs.
SCOTUS is an embarrassment and I thank whatever god an atheist thanks that I’m privileged enough to be leaving this country within the month. Good luck to everyone who has to continue living through this nightmare in the coming years.

Why bother? Just get a big rubber stamp that says “overturned” and use it on every lower court decision unfavorable to Trump. No need to try and make up a constitution-based reason for the decision, I think we can all drop the pretense at this point.
