America’s elite have exactly zero interest in protecting democracy.

*”In issuing her ruling, Simmons said the fake electors truly believed they were carrying out their constitutional duty by signing the fake documents.*

*” ‘Right, wrong or indifferent, it was these individuals and many other individuals in the state of Michigan who sincerely believe, for some reason, that there were some serious irregularities with the election, or with the voting, and that somehow their candidate didn’t receive all the votes that was intended to for them,’ the judge said.*

*Their actions were ‘prompted by that belief,’ she said, and therefore lack the criminal intent required to convict.”*

I have FULL belief that all retailers are enriching their shareholders and CEO’s while screwing me over with their prices. So I’m justified to steal whatever I want now?

We’re basically holding full grown adults, who were granted tremendous power and responsibility, to the same standard as toddlers. Great.

Weird how the loudest guy in the room always goes mute when this topic shows up.

“  saying that the state failed to prove the 15 men and women were knowingly trying to break the law.”

Whatever happened to “ignorance of the law is no excuse for breaking the law”?

That’s on top of the judge saying these people knew exactly what they were doing, they just claimed to sincerely believe they weren’t committing any crimes, so they are apparently incapable of committing a crime.

„it’s not a lie if you believe it.“ – ~~George Costanza~~ Judge Kristen Simmons

      Jesus fucking wept.

I REALLY believe I should have all of that judges money and property.

is this a way of saying they are not guilty because so mentally incompetent they can’t be held accountable?

    8. >A Michigan state judge on Tuesday dismissed charges against the fake electors who signed certificates falsely claiming President Donald Trump won Michigan in the 2020 election, saying that the state failed to prove the 15 men and women were knowingly trying to break the law.

I’m pretty sure this judge would *also* remand someone to ICE to be deported for jaywalking after they crossed traffic to pull nuns and orphans from a burning bus.

    9. You can always tell when a judge has a preconceived ruling , then trying to twist logic into a reasoning as to why . The issued ruling makes no fucking sense to anybody with any common sense at all. The SC does it all the time. Writes bullshit that doesn’t have a damn thing to do with the original case. Square peg, round hole ..

      This is the insanity defense.

You admit to committing the act, but you say you were legally incapable of forming the requisite intent and are thus not criminally responsible.

So, there you have it. MAGA is now a legally determined mental disorder, right?

Prompted by belief????? What a load of sh“t. So much for relying on facts, and letting recounts disprove them. Just say you believe the space lazers gave trump the win and let the courts say ‚goos enough for me‘

I naively believed that enough good people were still around to prevent the total destruction of this country but I was wrong. It turns out Americans really do want to destroy their entire country and way of life and no one is going to stand in their way

While criminal intent is an important part of cases like this, and we generally dont want to be sending people to jail for fraud if they genuinely didn’t know or think they were doing anything wrong, there are standards of reasonableness that are supposed to be taken into account.

I struggle to see how these 15 people’s belief in a conspiracy theory can be seen as a reasonable belief. A reasonable person wouldn’t sign their name to a legal document claiming to be an elector despite the official electors having been publicly chosen already (and this effort explicitly being a reaction to that) and not suspect they may be doing a fraud.

      This will likely be appealed.

    14. By this logic, if a murderer sincerely BELIEVED their victim was evil or a demon, then their actions would be justified by the law?

    15. MyFirstCarWasA_Vega on

THIS has got to be overturned; otherwise, any future election where people want to „play pretend“ that they do not believe the results, they can go commit crimes to change that outcome. No way this stands.

So Republicans can break literally every law and norm with no repercussions, but heaven forbid Democrats do anything to benefit the citizens, that’s somehow always unconstitutional.

    17. No-Connection7765 on

Nothing is ever going to change until people involved in things like this start facing consequences for their actions. Lack of accountability is destroying this nation.

People focus on the J6 events, but that was just a distraction. THIS was the real coup attempt. And these fuckers are going to walk. I can’t believe Trump is going to be a villain *his entire fucking life* and never receive any consequences.

    19. near_to_water on

This is exactly what ‚white privilege‘ is. They’re allowed to get away with anything but if it were any other race, they would already be in prison by now. This is also why America is crumbling under the weight of it’s hypocrisy, lies, racism and hate.

    20. I see we’re back to the “if they genuinely believed they were right, there was no crime” horseshit again?!? WTF?

    21. This will be appealed and if the appellate court has any sense, reversed. Whether the fake electors had the requisite _mens rea_ is a finding of a fact that only a jury can determine. It cannot be resolved pretrial as part of an effort to dismiss a case.
