Ah, the will of the people. Governement governig and not being servantsof the people. They need to read their remit.
Sensible decision. There is no point of law for them to appeal, and in any case it was only ever a temporary injunction until the full hearing of the case in October.
Shit headline. It’s the injunction being refused they can’t appeal.
This looks technically correct in the sense there isnt a point of law. At the same time the ruling is so absurdly subjective this all seems perverse.
I don’t understand why the council have gone down the injunction route surely there must be a hundred other ones they can use to render the premises inoperable and just claim Wednesbury Rules on?
