Also habe ich kürzlich einen Studentenkot in der flämischen Region gemietet. Ich habe es nicht gesehen, bevor ich es mietete, und als ich ankam, bemerkte ich, dass die Wohnung viele Probleme hatte. Der Geruch war sehr schlimm, fast nähgemäß. Es gab Wasserschäden und ich fand einige tote Insekten Eier an der Tür. Es gab auch eine kleine Fläche in der Wand, die Ameisen aß. Das Bett war befleckt und es gab Schimmel um die Liste entlang der Wände. Ich habe nur die Hälfte der Einzahlung bezahlt, bevor ich den Ort sah, und sagte dem Vermieter, dass ich dort nicht leben kann und den Schlüssel zurückgab, während ich nach etwas anderem suchte. Jetzt habe ich ungefähr 500 € verloren, da sie es nicht zurückzahlen will, da sie der Meinung ist, dass es für sie unfair war, dass ich das Zimmer aufgegeben habe, als sie es an jemand anderen hätte vermieten können. Laut dem Vertrag hat sie das Recht, 2 Monate Miete als Strafe zu verlangen, da ich keine frühere Bekanntmachung gegeben habe. Sie hat mir das noch nicht erwähnt, aber ich habe Angst, dass sie es später sowieso anfordern wird. Und über die Einzahlung habe ich das Recht, den vollen Betrag zurückzufordern? it’s dirty and poorly maintained, but i don’t see anything that in itself is a reason to void the contract.
If you want to find good reasons to cancel the contract, you’ll need more serious stuff, like:
– not having roof insulation
– ‚enkel glas‘
– wet spots and mold problems that are not caused by lack of ventilation
– heating that uses gas & has ‚enkelwandige schouw‘
There are the big hitters in getting the appartment approved for the „Vlaamse Wooncode“, fail on enough of these and the contract is void because it’s not suitable to be rented out.
Why didn’t you see the place before you signed? This is crucial before you sign contracts like this.
Say that if she doesn’t give the 500€ back you will contact the communal administration with all your pictures. Talk about the mold, the insects, ask if the apartment is in electrical compliance. It’s illegal to rent unsanitary housing.
I know I would rather pay back 500€ than having to face any of these issues with an administration.
She won’t be able to make you pay more, just refuse and if she goes to court, which she will never do, you can defend yourself with your proof. And she will certainly not go to court because that would mean risking you to show how disgusting the place she tries to rent is.
