California is playing this perfectly. Letting Texas make the move first will squash the California Republicans to sue California for their redistricting effort because all Newsom has to do is point his finger at Texas doing it first.
Even if the Supreme court gets involved, I do not believe that it will fall under one of the partisan Gerrymandering or Racial Gerrymandering, but both.

This is actually a good thing in the long term. Texas is a purple state that’s been ruled by extremely narrow Republican majorities and minorities for several election cycles. The underlying principle of gerrymandering is you take Republican voters in safe districts and put them in purple districts to shift them red or you take blue voters in purple districts and move them into blue districts to, again, shift the purple district red.
The problem with this is that you can’t do this infinitely. There are federal and state constitutional guidelines on how large a population within a district can be relative to other districts, and in every state the population differences between districts must be under 1%. Why does this matter? Because gerrymandering is about making majorities slimmer to win purple seats. As Republicans lose voters, and they are and have been for decades, they have to gerrymander those purple districts more and more, which slims their majorities in safe districts. This is extremely dangerous when you have a polarizing candidate and party like Trump and MAGA because a major election shift won’t just cost you the seat in the purple district you gerrymandered to maintain control, you could also now lose the „safe“ district you slimmed your majority in to strengthen the purple district for your political party, causing a domino effect of lost seats both nationally and in your state legislatures.
This works in a place like California where less than 35% of the state votes Republican, but in a place like Texas that has been heavily gerrymandered for decades and has been slowly losing its grip on the state and federal elections, you run the risk of a historic blowout that can never be undone. So, I say this is a good thing, especially as Democratic governors with stronger majorities are redrawing their own district maps in ways that are safer for their majorities to counteract Republican’s overtly anti-democratic election theft.

Maybe it’s my incurable optimism but I have a feeling this might backfire and they might not win all of these new seats. I mean people are pissed and it’s only going to get worse before next year. I know that a lot of people don’t pay attention but a lot of people, especially Republicans are. Maybe they’ll still vote Republican but maybe not a MAGA. Or go independent. I think reps like Jasmine Crockett have a chance to turn the tables on these people. Like I said, incurable optimism.
