      I think it will be hard to find many people that agree that immigration status *should* be a factor considered in court.

      The strict rules around the immigration system lose all their merit if we bend judgements in order to ensure people going through the (supposedly) highly scrutinized system aren’t negatively affected and have their claims or status denied or revoked.

      Why is it that when I hear „conservativea say…“ it is usually a lie, something taken completely out of context or disinformation. And it is usually said with little to no pushback nor any tangible consequences, except for the targeted group or program.

      If you read the article, the Experts don’t disagree the system favors non-citizens, they disagree that that is a bad thing.

      I always read „experts say“ headlines as, „We called around until we found someone with a relevant degree who would say the thing we wanted them to say.“

      Expert opinion is still opinion. If you want to disprove something, use stats.

      This is the same logic used by MAGA where they say non-citizens are taking advantage of America. It’s dog whistling to their base of uneducated hicks eager to blame other people for all their problems in life.

      Conservatives say absurd things. Media, even when falsifying statements, repeat absurd Conservative talking points. Then those absurd talking points get puked out here, fists pounding. It’s how even my dad is terrified that men in women’s clothing are lurking in women’s change rooms to steal their trophies and rape them.

      Basically for certain crime and depending on the sentencing, you will get deported and don’t have the ability to appeal the deportation order if you are a non-citizen. Some judges would lower the sentencing so the defence can have a chance to appeal (so they won’t be deported)

      I’ve yet to hear a cogent argument as to why immigration status should be treated as a mitigating circumstance when it comes to sentencing just the assumption on the part of the legal minds in this country that it obviously should.

      If somebody commits armed robbery and it jeopardizes their immigration status, then that’s just the immigration system working the way it should.

      It’s like the judiciary thinks Canadian society owes a mulligan to new arrivals or something. „You get a do-over for that one. Go ahead, we won’t count it.“
