Ford is really in for disappointment. When a government is fighting against a justice decision, it shows a lack of leadership and ownership over your own failures.
Personally, I’m very conflicted about this case. Because while I don’t think that judges should be in a position to make urban design decisions, I also don’t think that governments should be in a position to arbitrarily deprive Canadians of life and security of the person.
*The Government‘s own evidence* asserted that the bike lane removal would:
(A) Increase congestion,
(B) Cause roadway deaths
If the government could articulate *any* benefit to the bike lane removal, this wouldn’t be a Section 7 violation. But their lawyers were unable to do that. So this is just the government putting people in harms way for a totally arbitrary reason, and thus a violation of Section 7 of the Charter.
I would imagine once the adults in the court of appeal get a hold of this, they’ll side with the province – as they should.
