Dual use as in two uses, the intended use, research, which occurs if the virus remains confined to the interior of that lab, and the misapplication, which occurs if the virus escapes beyond the exterior of that lab and into the public environment.

The misapplication of the virus, utilizing gain of function research constitutes the use of a biological weapon. The virus itself meets the definition.

As far as the vaccine is concerned, since the authorities didn’t inform the public as to the true nature of the virus, that constitutes lack of informed consent as people considered taking the vaccine.

My nephew had to take a mRNA vaccine to continue his college education. He wasn’t told that the vaccine was a countermeasure to a man-made virus. Man-made virus and mRNA vaccine are two peas in a pod.
