I had no idea these were legal.
Well, I guess they aren’t.
Saw this the other week and immediately wondered how they were getting away with it. Guess they weren’t.
Crazy. Who okayed that?

Grey area. If the law states „smoked“ then the supermarkets are quite correct, vapes do not produce smoke so therefore by definition cannot be smoked. Before some pedant argues, nobody goes around saying they smoke a vape. The common usage is vape or vaped.
The being said, the supermarkets should know better than to be advertising any form of nicotine consumption.
