Since this was a press conference, none of those exceptions appear to apply.
The First Amendment to the United States Constitution protects every person’s right to inform the public about government actions. It also protects Senator Padilla’s right to question Secretary Noem.
Unfortunately, given Secretary Noem’s apparent misunderstanding of habeas ~~corpses~~ corpus–the principle that no one on U.S. soil can be denied due process regardless of immigration status–it’s no surprise that the department she leads has repeatedly violated the God-given rights protected by the 4th, 5th, 6th, 7th, and 8th Amendments. And sadly, it seems her DHS agents are just as unfamiliar with the First Amendment as well.
