Ich hatte einen Termin zur Familienzusammenführung. Mein Mann ist Brite und wie auf der offiziellen Website steht, ist ein Sprachzertifikat nicht erforderlich, wenn der Ehepartner aus Großbritannien stammt (Screenshot und Link im Anhang). Zu meiner Überraschung sagten sie heute, als ich hinging, nein, ich muss ein A1-Dokument vorlegen. Was soll ich in diesem Fall tun? Wir können es uns nicht leisten, noch länger voneinander getrennt zu sein. Wir haben bereits 16 Monate auf den Termin gewartet und jetzt muss ich weitere drei Monate auf einen neuen Termin warten. Gott weiß, wann wir ihn bekommen. Das ist Familienzerstörung, keine Familienzusammenführung.

Can you link to where it says to A1 very is required? I thought it was required for all nationalities.
I’m from the US – when we applied five years ago, they tried to do the same to me. I just showed them clearly where the law says this is not the case and stood my ground and they accepted it. They eventually made me show them a college degree (which I have) and after a few phone calls, we moved on.
It’s simply the law and it’s not up for debate.
Did your husband come to Germany pre or post Brexit?

There it says that if YOU are British citizen (or from another of the states named in §41 AufenthV or from the EU/EWR), then your spouse don’t need German skills.
So is that the case?
Stand up for yourself then. Go and show them the law. The law is the law and they can’t change it
We are missing information here but I think OP is mistaking the family reunification of spouses from EU citizens.
If both are UK citizens that means the husband is not an EU citizen and therefore it doesn’t apply.
You are reading the law wrong, your nationality matters not your husbands. Are you from the UK or not?
I had this same confusion and got different answers from different sources. Unfortunately if they’re telling you that you need an A1 certificate then you need one. A1 is very easy and you can get an exam done for less than 100 Euros in most cities within a week.

The person (spouse) that already lives in Germany has to be a citizen of e.g. the UK. What is the logic behind it? Doesn’t make any sense to me…
After a somewhat lengthy search in the visa handbook of the Federal Foreign Office („Beitrag Sprachchnachweise“ Seite 22/28 Stand 06/2024):
2.4.6 Reunification with a nationality that authorises visa-free entry
A general exception to the requirement to provide proof of language proficiency applies to the reunification of spouses with those entitled to long-term residence in Germany due to their nationality, Section 30 (1) sentence 3 no. 4 AufenthG.
This applies to holders of the nationalities listed in Section 41 (1) and (2) AufenthV (https://www.gesetze-im-internet.de/aufenthv/__41.html). The granting of exemption from the language certificate applies in the cases of § 41 Para. 2 AufenthV regardless of the question of gainful employment; § 41 Para. 2,
2. HS AufenthV relates solely to the question of visa exemption on entry.
The exemption from proof of language proficiency is based on the existing favours for spouses with a certain nationality who are entitled to reside in Germany, so as not to undermine these by imposing stricter requirements in the case of immigration with their spouses. The decisive factor is therefore the nationality of the foreigner to whom the spouse is joining, not the nationality of the joining spouse.
For the reunification of spouses with persons entitled to freedom of movement / Union citizens, see section 2.1.2 above.

TLDR: the citizenship of the „Stammberechtigten (original beneficiary)“ applies, in this case the husband, who is a UK citizen in Germany. This means that NO language certificate is required, the information from the embassy is wrong.
