Entschuldigen Sie, dass ich auf Englisch schreibe. Ich lerne gerade Deutsch. Also … Heute hat die Firma, bei der ich arbeite, bekannt gegeben, dass sie komplett in eine andere Stadt umzieht. Ich arbeite seit 3,5 Jahren in einem Lager in München und dieses Lager wird spätestens bis Ende September geschlossen. Sie haben uns allen eine Abfindung angeboten. Ich habe einen unbefristeten Vertrag und soweit ich weiß, brauche ich 0,5 Monatsgehälter x (Anzahl der Jahre) und die Firma, bei der ich arbeite, bietet 0,3 Monatsgehälter x Jahre. Mit Zuschlag – darf nicht mehr als 3000 Euro brutto sein. Ich möchte fragen: Ist das legal? Und ich dachte, die Firma muss einen 3 Monate vor der Kündigung informieren. Kann mir bitte jemand helfen und/oder mir ein paar Anweisungen geben?

    1. They probably will offer an Auflösungsvertrag. If you sign one, you will be barred from unemployment benefits for three months.

      I doubt 3k will be more than three months‘ wage.

      In general, there is no mandatory severance payment (also not 0.5xyears) in Germany.

      I would talk to your Betriebsrat and/or a representative of your relevant union.

      Did you receive a written termination letter yet? A letter that clearly states „hiermit kündigen wir das bestehende Arbeitsverhältnis zum“ Or something similar? Because otherwise you haven’t been fired yet. It just has been announced that you will be fired. That’s an enormously important difference.

      What they offer here is very likely a mutual termination agreement – both parties agree to terminate your working contract mutually and without regards to the usual notice periods. As compensation for you agreeing to that voluntarily, they offer you the money. Which they do not have to do! They do that so people accept it and in turn don’t sue them. Half a month’s wage per year working there is the usual rule of thumb, but it’s not legally prescribed anywhere! It can be higher, it can be lower, it can be negotiated.

      If they actually fire you (instead of a mutual termination agreement) you aren’t entitled to any compensation. But you can of course sue them, if the termination was wrongful somehow. For example if they didn’t obey the notice period in the contract. 3 months notice period would be standard, but it’s not a given. Legally other periods are possible.

      So, first things first: what’s the notice period in your work contract? That’s a really important question in this scenario.

    3. Well.. if I’m not mistaken: Technically since they are offering you to move with them and keep your job they are not even mandated to give you *any* severance pay. They could just terminate your contract if you refuse and you get nothing.

    4. My direction is: are you strongly tied to München? Do you have target to have permanent residency or naturalization? Do you think you can find another job easily if you do not move?
