Cmon guys, bailouts are for the poor corporations, not the greedy lower and middle-class individuals

    2. rohitsatija889 on

everyone suddenly starts understanding everything about tariffs once the refunds are on the table lol

    3. DigLivid1350 on

I just gave FedEx 60 bucks for tariff and processing fees for 3 packages. Where my refund ?

    4. Interesting argument but is there any law or precedent that would actually support it?

    5. spending their tariff rebates on the lawyers, who are the only ones getting rich from this lawsuit.

    6. This is by design. Every tariff was paid for by the consumer passed on to us through higher prices. Not only are these companies going to get free money, the prices aren’t going down either. This entire administration is a joke.

    7. I suppose the refunds go to whoever actually imported the product and paid them. In most cases this is the American subsidiary of in this case Nintendo. Or like your local electronics shop. Of course in the end they raise prices to end customers to offset these costs. I don’t see how customers would be able to sue for charges that they didn’t specifically see in their price tho.

What about people who bought new vehicles. I would expect a class action suit as these tariffs are averaging 6k on new foreign cars and about 3k on ‘domestic’

Wait!! So Nintendo raised the prices due to the tariffs, then they get a refund and don’t give that back to the customers??? WTAF?? More corporate greed!! F them!!

I think refunds are definitely necessary for the consumer at this point. On the other side of it.. due to these corporations getting the refunds it could potentially lower the prices of goods a decent amount. Not really saying that’s a win because the consumer still lost a lot of money through the year.

    11. I believe its truly distopian that the president ilegally creates tariffs, companies pass the prices to consumers, tariffs are declared illegal and the companies get the money back. But that is a hard case to win since:

1.Nintendo never claimed to raise the prices due to tariffs, they always said „market conditions“.
2.Nintendo raised some prices in places different than the US.
3.Nintendo did not raise the price of the Switch 2 even after the tariffs.
      4. Nintendo declared that the Switch 2 price was without tariffs in mind.
      5. It is not illegal to raise prices, unlike the tariffs, which were illegal according to the supreme court.
      6. People had the option of not buying, unlike Nintendo which had to pay the tariffs.
      7. There were other reasons for price increases, like RAM and logistical getting more expensive.

So yeah, at most people would get a few dollars from Switch 1, Amiibo and Switch 2 accessories increases. Which would be great, but unlikely to happen.

lmfaoo just suing Nintendo is a choice but hopefully it means it sets a legal precedent that other companies follow preemptively like how they capitulated to executive orders with no legal mandate

    13. This is the right approach. If precedent is set that corporations deserve a refund, individuals deserve them, too. Corporations are people, after all.

    14. This is going to turn into a PPP loan 2.0 situation. Really need to “incorporate a business” and say I paid more due to tariffs.

    15. do they have a leg to stand on? I’m not a lawyer, but it would seem that even if the tariffs were illegal, Nintendo passing on the costs of those tariffs would be legal, right? Nintendo, could certainly return them, but if they chose not to, wouldn’t the customer be just out of luck?

    16. scarletofmagic on

I doubt they would get much refund since Nintendo already stated that Switch 2 price is without tariffs in mind. The best they will get out of this is refunds for Switch 1 after price increases, amiibo and accessories purchases which are not a lot.

Since Nintendo pricing never changed I don’t think this has a chance in hell

    18. Time_Zombie_4431 on

Hope the people win but Jesus fuck buying dogshit Nintendo products AND paying for them with increased tariff prices is beyond moronic.

Maybe that money shouldn’t go to either of those morons.

    19. Is this the way to try to ensure that no one gets any of the money because it’s all tied in a three-way legal battle?

    20. That-Interaction-45 on

Nintendo is not the one we should be suing. It’s the trump administration

    21. Nintendo buyers have no problem paying a fanboy tariff with the prices they are willing to pay for anything with Nintendo on it.

    22. Nintendo should just file for immediate dismissal, since nobody has gotten a refund yet, and nobody will for months to come.

„Nintendo has been sued by two players in the US“

I’m not a gamier, much less a Nintendo gamer, but from what I understand Nintendo has a reputation for having extremely good lawyers. So 2 random people are likely not going to amount to much. Still I wish the 2 of them luck, but unless they band together witch a bunch of other people in the form of a class action I don’t envy there chances.

    24. I saw a previous post talk about this, and there are only two people that did this.

    25. Technical_Sea9236 on

Yeah. You need to sue the Trump administration if you want a tariff refund from his arbitrary tariffs. Not Nintendo. Have fun though.

    26. danSTILLtheman on

I’m curious how much of the increase Nintendo absorbed vs. passed on to consumers. It’s much easier for a consumer to change the product they buy than a corporation that has established supply chains that do not easily move

    27. RustyDawg37 on

Yeah, they said they were raising prices due to tariffs.

Don’t say dumb shit like that if you don’t want to get sued for it later.

    28. Sweet.  Guess I’ll be getting another coupon for Dragon Warrior in the mail.

    29. catplayermeow on

To sue a gaming company for being abusive to the players. Hmm, almost like if someone hacks your internet wifi to turn on your Xbox by itself to create fear inside your home or to somehow bait or gaslight you psychologically. Right in the morning too as you wake up because they can’t wait to destroy your whole day.

    30. JiminyWillikerz on

They did announce the price of accessories, and then reactively raised them. I wonder if there’s a case here.

    31. maxdragonxiii on

they at least can lower prices or make it not apply to Canadian versions of the Switch 2. its already expensive as it is.
