Good. Should never have been possible to raise that defence in the first place.
Should be a very simple:
if they’ve been convicted of indictable offence then public interest supersedes human rights of the migrant and their family and they can be deported.
There’s too much ambiguity and wiggle room in the law, and the judiciary seem to be hell bent on using that discretionary power to let everyone stay here. So that discretion needs to be taken away.

I see these cases on here a lot and then the human rights of the person is brought up and then they magically get to stay.
The guy who’s child didn’t like chicken nuggets in there original home, so they didn’t send the dad/family back, is a complete joke.
Well done to the judge I suppose but I don’t care if he would or wouldn’t face significant barriers reintegrating in Nigeria. I just want him gone.
