I worked for the government when DOGE first came in. They basically provided a list of keywords and cancelled any program that has any of those words in them and didn’t review the context of how they were used.

Let’s be clear, everything DOGE did, was illegal. The locations they went to, the systems they accessed, they did not have clearance or authorization for. I cannot begin to count the number of laws they violated starting with criminal trespass, breaking and entering, and unlawfully accessing classified materials without authorization. If there’s any justice, everyone involved, including the officers who assisted in accessing secure locations, will eventually face criminal charges.

This lawsuit alleges that the termination of federal grants dealing with Dei related topics was invalid because it was „arbitrary and capricious“ and therefore invalid as an administrative action.
While the testimony seems very stupid, the much higher likelihood is that it is malicious. A regulatory action taken specifically in accordance with a written administrative order is much less likely to be arbitrary and capricious. Therefore, the witness is specifically refusing to offer his own definition of DEI except through the administrative order.

I’m embarrassed for him but then again I question his ability to be embarrassed.
It seems like he was coached to say ‘whatever was in the EO’ but wasn’t smart enough to figure out what to do when that didn’t work.
