    Niederlassungserlaubnis / Permanent Residency Application – Verlust des Arbeitsplatzes während ABH die Prüfung durchführt

    Hallo Leute,

    Ich befinde mich in einer unangenehmen Situation.

    Ich habe am 14.11.2025 eine Niederlassungserlaubnis / PR beantragt. Zu diesem Zeitpunkt konnte ich mich nach 21 Monaten als Blue-Card-Inhaber mit einem Sprachzertifikat bewerben.

    Kurz darauf wurde ich entlassen und beginne am 1. März 2026. Ich werde meinen Aufenthalt aus meinen eigenen Ersparnissen finanzieren, mehr als 50.000 auf meinem Bankkonto, ALG 1 und einer Abrechnung, die ich am Ende des Monats erhalten werde. Das zweite Bild verrät mir, dass ALG 1 nicht gegen die Bezahlung des eigenen Aufenthalts wirkt.

    Meinen Sie, dass dadurch mein Antrag ungültig wird, denn laut Paragraph 18 soll das Dokument ohne Ermessen „ist zu erteilen“ ausgestellt werden, wenn die Voraussetzungen erfüllt sind, die in meinem Fall sicherlich erfüllt waren?

      Btw, I will absolutely involve a lawyer since the 3 month period of decision has passed. It doesn’t necessarily mean that they have to say something by then, just gives applicants the chance to file an Untätigkeitsklage. I am not going for a lawsuit first, will ask my lawyer to review my Ausländerakte.

      What do you expect to happen here?

      They aren’t going to give you permanent residency while on unemployment.

      You should expect your application to get put on hold until you find a new job and pass Probezeit.

      Each Ausländerbehörde sees this differently. The key point is that you have to show the ability to fund yourself long-term without relying on public funds (I mean here Bürgergeld and not ALG1 – which is an insurance). Some offices will put your application on hold while you find another job, which is how they interpret the ‘gesicherte Lebensunterhalt’. Others might give you some leeway, but it depends really on where you live and your own circumstances.

      You also would’ve needed to inform the Ausländerbehörde that you lost your job (your employer has a requirement to inform them too). I assume you’ve done this, though?
