      Noble, but zero chance of this actually being ratified in the current political environment.

      **However**, they should still do it and have all the blue states ratify the amendment right now. Then if there’s ever a Democratic president again the red states will immediately change their tune and ratify it.

    4. The GOP congress is already ok with defending Trump over child rape, I doubt pardon power will be their last straw.

    5. Will never even be considered for vote as Speaker Johnson will ignore it based on Trumps orders.

      Amendments only happen when both sides see a problem. Right now Republicans don’t see any problems with Trump selling pardons for personal profit. And the supreme court doesn’t see it as a problem since they have Trump immunity from official presidential duties so Trump selling pardons cant even be brought up in federal court.

      It sounds good because Trump is clearly abusing it, but it was also used to protect people from his retribution agenda. So having a new trend of newly elected parties prosecuting previous administration members (guilty or not) gets really messy if you limit pardons.

      I honestly don’t like limiting pardon powers. There are so many raciest laws still on the books that need a sane president to pardon. So I want the next guy to fix those laws with pardons.

      I am so fucking tired of the way Newsweek phrases their headlines. You use „would“, not „to be“, when you’re talking about a *proposal* that has *no shot in hell of passing*.

      Why do democrats just waste time and political capital?

      Amending the constitution?

      How about writing some legislation that actually helps US, your constituents who voted for you?

      Verbiage needs to be added to include anyone who is a subject or target in any case where the President is a subject or target.

      However, we’ll never see another amendment to the current Constitution, assuming it survives the Trump Presidency. The country is too irrevocably polarized to receive the approval it would need to be ratified.

    18. The president can rescind any and all pardons they or previous administrations have issued. That’s one of the checks and balances. The constitutional rule against double jeopardy prevents this part from being abuse.

      So, if you went through the legal system and had a trial (jeopardy applied), get pardoned, then another administration rescinds it, you don’t have to stand trial again. If however you paid a couple million to get a preemptive pardon, then another administration rescinds it, you can still be tried. Any pardon you present will be declared null and likely confiscated by federal officials (and YES similar confiscations has happened in the past and been upheld).

      Trump „almost“ gets this, but if he really did rescind a pardon then all the ones he’s hoping to sell become worth less (not worthless as a few years reprieve might get things past statute of limitations).

      That’s hilarious. It’s an Article II power. It may be the only actual plenary power of the U.S. President. Propose away, pipe dreams about amending the constitution are just more pissing in the wind.

      Release the gd unredacted files.

      This should be done. Trump has shown that the power of the pardon is easily abused and exploited for his own personal gain.

    21. Congress should be able to veto a pardon. Also no pardons after the first year of presidency. Mass pardons at the end of a term are BS.
