How that couple is allowed to continue to offer this as a service is what’s fucks me off. They should be struck off a landlord register for a set period of time.
A lot of landlords are going to find themselves in bother by being lazy and stupid about trying to create fake „licensee“ arrangements. From the reporting that seems to be an element of what happened here.
It’s not actually that easy to create a licensee arrangement, especially if you’re not living in the property. It takes a bit of effort and expenditure in most cases. Landlords who are both stupid and lazy, and there are many, will find that they haven’t successfully managed it.
Of course even within a license arrangement it’s profoundly stupid to think that you can simply alter the terms of the agreement unilaterally and at will.
Hopefully more tenants seek advice and bring cases even if they think that a landlord has tried to bring themselves outside of regulation by calling them a licensee.

I hope he follows this up by seeking legal advice on what else might be legally relevant too. That situation is horrendous. If I were him I’d have a solicitor look at the situation in some depth.

Should have a read of the RTB testimony document, its demented. They decided to treat the whole place as an AirBNB then made him be the person actually looking after it (theres reference to their daughter also living there that „did not want to get involved in the AirBnB“) then when they got sick of him costing them AirBNB cash they backdated a bill of €15k for the „extra charges“ of doing things like using the dining table and using one of the fridges.

That rent a room scheme has like no protection legally and you don’t have to register to the RTB. It’s just waiting for students to be treated like shit by landlords. Students in these situations need to be seen as tenants with full tenant rights, not ‚licensees‘.
