The questions this asked, and the answers, may not be apparent to everyone. One of the underlying principles in law is a reasonable expectation of privacy, the question is, do we expand this to unauthorized use of our likeness and image even when taken from images that have no reasonable expectations of privacy.

I don’t the answer, and I’m not a victim, so I’m not sure I get much of a say, but personally, I’m not inclined to think an AI generated image that appears to be a person is the rightful property of the person it appears to be or should be exclusively under the control of that person… But that’s me.

People are horny. People fantasize. There are cave paintings, hieroglyphics, ancient sex toys that verify, fantasy is an innate trait.

Ugh, the implications of this are SCARY on a multitude of levels. First of all, where is the line drawn? Okay, explicit porn creations of someone being created and distributed without their permission is illegal. Good! Easy right? Fuck no! What about if that person was used as an inspiration for the resulting porn? Okay, ban any porn that even starts off as a real person without their permission right? Okay, how do then track the creative process to make sure you’re not infringing on free speech and creative expression? What if the person is an artist and draws inspiration from a person they met in real life before depicting some sort of drawing of them and asking AI to make that drawing into porn. Is that illegal? What if the artist combines two people or three people or four and the resulting depiction just happens to strongly resemble someone else? Can that person object? Ultimately every AI creation WILL look like someone, even if just by coincidence, does that mean all AI porn should be banned to prevent it?

Forget AI altogether, will it become illegal to draw an erotic picture of someone you met, for personal consumption? This is simply an issue of barrier to entry right? Artists can do this and no one can stop them, but the every day joe shouldn’t have that same ability via AI? Maybe not! But the difference is extremely subtle! For instance, what’s the difference between honing your artistry for a life time to be able to gain the skill to do something like that, vs. learning how to use photoshop or other editing programs to achieve the same thing vs. learning to program to create your own AI bot which can achieve the same thing, vs. downloading an existing AI module and editing it to achieve the same thing?

What if the law becomes so nebulous on these matters that it becomes nearly impossible for someone to know if they are violating it, allowing the government to use it in any situation it finds convenient to persecute people it deems enemies?

Are there differences between porn created for oneself vs. porn that is distributed? Perhaps a higher standard for the latter than the former?

What about depicting girls who look ‚young‘? What constitutes a look that’s 18 years or older? What about a porn actress who looks young and gives her permission for her likeness to be used in the creation of AI porn, would this potentially constitute child pornography? If not, how would this even be decided? Would we have a board of law makers whose job it is to decide some sort of specific criteria for what ‚looks‘ like child pornography, beyond being defined strictly by age?

The supreme court has previously said it can’t define pornography, but ‚they know it when they see it‘, does that setup a situation where the porn you possess can be considered inappropriate depending on who is doing the considering? Even if no real people are depicted. Does this mean anime porn will automatically be banned because some of the character resemble children? Forget the visual medium for a second, what about when this issue intersects with writing? Will it become open season on all writings about behavior deemed illegal? How will the difference between smut and art be established?

At what point will the government throw their hands up in the air and simply declare everything pornography and all pornography to illegal?

There’s simply no easy answers here. But the most disturbing possibility in my mind is that AI will serve as a pretext to both surveil our actions and curtail our rights.

Edit: I also feel compelled to add that on the flip side if our rights aren’t curtailed, that is ALSO a very scary future where this type of content becomes completely normalized and ubiquitous over time.

It’s not just yearbook pictures. Any woman who has any pictures on the internet may now have these pictures used for personalized porn.

The software for this is widely distributed for free and can be run on any consumer grade laptop with a GPU or equivalent. Computers aren’t going anywhere and neither is the internet. Moreover, whatever you ban in one country will be ignored in the others. This phenomenon simply can’t be stopped, no matter how many pearls are clutched.

On the good side, the entire commercial porn industry will be gone in a decade. Also, there’s very little motivation to acquire or distribute customized porn if you can create your own quickly on the fly.

This is the „innovation“ they keep talking about with AI. Fuck this.

…gross. That definitely feels like a violation. Unfortunately, I’m sure the laws are way behind on this. Even if they aren’t, it’s likely difficult to enforce.

What I don’t understand is why not actually encrypt the data they say they encrypt? From my understanding, the implementation to do so isn’t that expensive or difficult to include, so are they stupid or just being malicious?

The sheer amount of sexual harassment and blackmail this is going to lead to is horrifying to think about.

I am utterly shocked that anyone would do that!
