Seems like we have an activist judge on our hands here and her reasoning is as equally absurd in this case. She’s arguing that Leblanc failed because he didn’t not consider the fact that the applicant’s personal circumstances should override national security concerns. Read that again, she feels the applicant’s personal circumstances should override the Public Safety Minister’s responsibilities to national security.

This is why the immigration/refugee system is buckling at the knees. It takes several rounds of appeals to even reach the point in which Ministerial relief is being applied for. And then, once such relief is denied, some judge can just fucking get in there and tell the Public Safety Minister that, „No, *I* won’t allow this.“

Bill C-12 is desperately needed.
