Doch durch eine Einigung wurde die Anklage auf ein viel milderes Vergehen reduziert und die Höchststrafe auf nur ein Jahr begrenzt. Anschließend verurteilte ihn der Richter zu 180 Tagen Bezirksgefängnis, was bedeutete, dass er bei gutem Benehmen in 90 Tagen freikommen könnte. Der Deal bedeutete auch, dass er die lebenslangen Konsequenzen einer Eintragung in das Sexualstraftäterregister vermeiden konnte.
Staatsanwälte verteidigen diese Vereinbarungen oft damit, dass sie vermeiden wollen, dass ein minderjähriges Opfer das Trauma einer Zeugenaussage vor Gericht erleidet. Aber das Ergebnis ist dasselbe: Ein schwerer Missbrauch sieht aus wie ein Schlag aufs Handgelenk. Was noch schlimmer ist, ist, dass dieses Muster nicht zufällig ist. Studien zeigen, dass von den Republikanern ernannte Richter und Staatsanwälte in Fällen sexueller Übergriffe besonders häufig leichte Strafen verhängen, wenn der Angeklagte weiß und aus der Mittelschicht stammt, und rechtfertigen dies mit der Aussage „Er hat eine Zukunft“. Unterdessen drohen schwarzen und lateinamerikanischen Männern wegen geringerer Straftaten längere Haftstrafen.
Wenn Gerechtigkeit blind sein soll, warum geben dann Rasse, Klasse und Politik immer wieder den Ausschlag?
