      TLDR:

      * [Emilie Kiser](https://people.com/emilie-kiser-says-shell-forever-second-guess-not-being-home-during-son-trigg-s-drowning-in-emotional-statement-11795274?utm_campaign=peoplemagazine&utm_medium=social&utm_source=reddit.com&utm_content=comment)’s declaration from her [May lawsuit](https://people.com/emilie-kiser-says-shell-forever-second-guess-not-being-home-during-son-trigg-s-drowning-in-emotional-statement-11795274?utm_campaign=peoplemagazine&utm_medium=social&utm_source=reddit.com&utm_content=comment) to seal records about her son Trigg’s death is now public
      * At the time of her request, over 100 requests were filed for access to public records, and a [source tells PEOPLE ](https://people.com/emilie-kiser-says-shell-forever-second-guess-not-being-home-during-son-trigg-s-drowning-in-emotional-statement-11795274?utm_campaign=peoplemagazine&utm_medium=social&utm_source=reddit.com&utm_content=comment)this included requests for footage of the [3-year-old’s fatal accident](https://people.com/emilie-kiser-says-shell-forever-second-guess-not-being-home-during-son-trigg-s-drowning-in-emotional-statement-11795274?utm_campaign=peoplemagazine&utm_medium=social&utm_source=reddit.com&utm_content=comment)
      * In her declaration, which has been obtained by [PEOPLE](https://people.com/emilie-kiser-says-shell-forever-second-guess-not-being-home-during-son-trigg-s-drowning-in-emotional-statement-11795274?utm_campaign=peoplemagazine&utm_medium=social&utm_source=reddit.com&utm_content=comment), Emilie refers to her absence at the time when Trigg drowned: „I will forever second guess that decision, among many others,“ she stated

    2. It’s unfortunate that leaving her children in the care of her husband for one evening is a decision she has to second guess. But really, her/their decisions not to fence their pool, not to keep the pool cover on, and to routinely let their 3-year-old play near the unsecured pool are decisions she should have second guessed before this happened.

*“Nothing we have shared as part of my profession has depicted or been intended to depict anything but deep and adoring love within our Family.* ***That is how it should stay forever in my mind and the minds of all others.****“*

So she just wants the world to remember the Tiktok illusion, and not remember that her husband negligently sent their 3-year-old outside to play unsupervised by an unsecured pool while he watched a basketball game.

Just a totally needless tragedy. But talking at length about how preventable it was doesn’t help anyone, and I’m sure they don’t need to be told. Their marriage is probably ruined and their lives will never be the same. It’s awful.

    4. I really, really wish people would leave these people alone to grieve.

We know it was preventable. We know there should have been a fence. We know. THEY KNOW.

A three year old baby died and people just want to harp on it. And want the video of his drowning to be released…? If you’re one of those people, i just want you to know that i don’t need to know anything else about you to tell you that you’re a disgusting, awful person. Gross. Go watch some overly detailed true crime videos, loser.

I’m just so sad every time i see this.

She should have cared enough in the first place to keep a pool fence up, too. I do hope she’s haunted by these choices.

    6. Lately there have been a lot of deaths and tragedy among influencers. Normal people don’t live their lives online and I don’t know if it’s connected but I think it’s a bad idea to put everything out in the public for people to invade your life.

if she wants complete privacy and to be left alone she shouldn’t have put her son’s whole life online to make money off him.

I mean you live by the sword, you die by the sword. She pimped out motherhood online so she would not have to get a real job to make money. Her brand was maternity and her kid died. His death is on her husband for not watching the kid and her for not installing the gate and blocking people who got in her way to craft the perfect narrative for her to make cash. So she’s accountable, that’s it.

I don’t even get why a three year old would be outside playing by themselves. I get the father wanted to watch tv but just like throw a bunch of toys on the floor, close all the doors, and watch tv with your kid on the floor playing, in front of you????

I will never own a pool, I will get it filled in. I will never own a hot tub, I’ll get it dismantled or replaced.

I will have a *sauna* because my child cannot fall in, my family cannot have a seizure and drown, and at the very worst a bad medicine reaction will have me waking up on the floor craving electrolytes.
