The legal status of the flag itself is not altered. You can still burn it if you want, that’s perfectly legal. But if you burn it and then attack some Jews, the flag burning will be a factor in potentially bumping it up to a hate crime.
Burning was never actually mentioned in this case or ruling; a person (allegedly) choked a woman with a flag she had around her neck. That’s the context of why „grabbing“ it was bad here, OP
