
Hallo, ich habe vor, mit meiner Frau Immobilien zu kaufen. Wenn mein Frau Beitrag nicht so viel ist wie ich, muss sie Geschenksteuer zahlen. So bestimmen wir den realen Beitrag als einen Betrag, den wir von der Bank nehmen, dann zahlen wir beide zurück. Ihr Beitrag zur Rückzahlung wäre nicht mehr als 25%. Wenn jemand die Wohnung kürzlich gekauft hätte, bitte führen Sie bitte? Ich habe bereits Screenshot von Vero gelesen, bin mir aber nicht sicher, wie ich den echten Beitrag für jede Person am Ende bestimmen soll.

If you’re taking a loan that will be paid „somehow“, I wouldn’t worry about any gifts. Pay into a shared account and pay the loan from shared account.
So you would own 50/50 but will pay 75/25? I’m pretty sure that there’s no need for paying a gift tax in this case because you are allowed to pay your spouses bills. Just take one joint loan from the bank. But like every time with tax related questions, better ask Vero. They have a very good customer service.
Edit: Apparently I was wrong, making my suggestion of asking Vero even more relevant.
You want to buy the property 50/50, but you will be contributing more to the loan repayment than them?
I would probably contact and ask verotoimisto about it, but my naive conclusion would be that you would count how much extra you’re paying and count the amount of gift from that.
For example, if you in total paid back 20k€ in the first year, and the balance was you 15k€ and them 5k€, you could deduce that you gifted them ~~10k€~~ 5k€. You can deduct the 5000€ from this for the first year, and then you would have to pay the full amount on the following years, until you can deduct that again after 3 years.
Not sure at all about this though, just what I would guess.
Why not just buy the apartment 75/25? You dont have to have equal shares of ownership. Both can even take their own loans if you want.
