To think I was relieved when this lot won the election.

So, as expected, this is Conservative MPs straddling the line between being misleading and downright lying – probably why we’re stuck quoting a random website about it. And this is the Conservatives‘ fault – they screwed up.

Extradition is both a legal and diplomatic process (due to the UK’s dualist approach to treaties and international law) – so it involves laws (the Extradition Act 2003), and treaties (with other countries, or via international groups like the EU or Council of Europe).

Under the Extradition Act there are four kinds of territory;

* Part 1; EU-related ones, where there is a „surrender“ process that is fairly simple, similar to as it would be if someone in England was wanted in Scotland, with a quick check by the courts that all the paperwork is in order,

* Part 2 Category A territories; mostly Council of Europe states, where it has to go through both the courts and the Government, but we trust the country’s own legal system enough not to check their working,

* Part 2 Category B territories; where it has to go through the courts and Government, and where we don’t trust the country’s legal system enough and so the courts *do* check their working,

* Other territories; which aren’t designated, but which can be extradited to as if they were Part 2 Category B territories if the Government has some specific treaty in place and confirms this.

At the moment Hong Kong is a Part 2 Category B territory *in law*; extradition is possible, and follows the standard process.

Except back in 2020 the UK Government suspended its extradition *treaty* with China, due to the changes going on out there. But the idiots in charge here never got around to removing its designation as a Part 2 Category B country.

So for the last 5 years the Chinese Government could have requested an extradition, and it would have had to go through the legal Extradition process… even though the UK Government didn’t have a working extradition treaty with China.

Labour are now fixing this by removing Hong Kong’s designation as a Part 2 Category B territory.

What the Conservatives are being dishonest about is that this moves Hong Kong to that fourth category of territory; whereby *if* the Government does sign up to an extradition treaty with Hong Kong, and *if* there is a request, that request could be processed under the Part 2 Category B system.

But that’s currently the same situation the UK has with mainland China.

Unlike the current situation where – thanks to the incompetence of the Conservatives – people could be extradited to Hong Kong *without* a treaty.
