Count the votes that were cast by the deadline. Reasons for votes not being cast shouldn’t be considered. Things happen; cars break down, emergencies happen, and mistakes get made.
Elections should not be subject to unending contention because someone didn’t get the result they wanted.
I’m curious, if this was appealed, what remedy are the courts able to provide? Another recount including the misprinted ballot? Vacating the results and requiring a by-election?
Not till the lawsuits come. There is going to be a by-election, I’ll guarantee you.

Ridiculous. Any vote cast should be counted. People’s votes should not be thrown out when they were not at fault, EC was.
It’s worth noting they’re leaving the door open for it to be officially challenged. I am a bit surprised that it’s remaining final as things are but it sounds like there aren’t really any mechanisms for Elections Canada itself to challenge the result

So whose fault is it that it didn’t get delivered? Did Elections Canada provide the wrong postal code, or was it the elector who made a mistake? None of the articles are really clear about this, though it seems to be key information.
Regardless, there’s going to be a long series of court cases over this, might even see it annulled next year.
Elections Canada dropped the ball here by misprinting the mailing label. There should definitely be a thorough review of what happened. They have the option to challenge it, and they should. The proper legal channels are available to make sure rules are applied.
Canadians don’t have the right to have our votes count, but we do have the right for our votes to be counted! In this case, had the vote been counted it would have counted.
